This book focuses on maritime employment from a private international law perspective. The first chapter analyzes the background against which international jurisdiction and conflict of laws rules are drawn up and examines uniform law in this context, in particular the 2006 Maritime Labour Convention and the 2007 ILO Convention No. 188 on Work in Fishing. The second chapter addresses international jurisdiction issues as regards individual employment contracts, while also exploring other issues (e.g. insolvency-related and social security matters) that are subsequently revisited in the third chapter while discussing conflict of laws issues related to said contracts. In turn, chapter four focuses on collective labour relations and private international law, i.e. collective agreements, strikes and other forms of collective action and information, and on the participation rights of employees in business matters

A diferencia de los dos precedentes proyectos de Convención sobre procedimientos de insolvencia, el Reglamento (CE) núm. 1346/2000 no establece una regla específica sobre vis attractiva concursus; y ello a pesar de que el Tribunal de Justicia de las Comunidades Europeas ya había sostenido en el caso Gourdain c. Nadler que las acciones que derivan directamente de la insolvencia y guardan una inmediata relación con el concurso no están incluidas en el ámbito de aplicación de la Convención de Bruselas.Este trabajo aborda esta problemática y el estado de la cuestión después de Seagon c. Deko Marty Belgium, puesto que la relación de acciones comprendidas en el foro concursal, omitida deliberadamente por el legislador comunitario en la redacción del Reglamento de insolvencia, ha de ser realizada ahora por el Tribunal de Justicia. Contrary to both Preliminary Convention Drafts on insolvency proceedings, the Insolvency Regulation does not set out a specific rule on vis attractiva concursus. This silence is surprising given the fact that the ECJ had already held in the leading case Gourdain vs. Nadler that decisions deriving directly from insolvency proceedings, and closely connected with them, are not included within the scope of the Brussels Convention.This paper tackles this background and the state of the question after Seagon vs. Deko Marty Belgium: the list of claims attracted by the forum concursus, deliberately not laid down by the Insolvency Regulation, is now to be compiled by the ECJ.
